End User License Agreement (EULA)

Thanks for using our product. By downloading or using our app Remove BG – Background Remover (the "App"), you have understood and accepted this End User License Agreement (the "Agreement" or "EULA").

This Agreement is between you and Kruti Italiya (the "Developer", "we" or "us") only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the App and its content.

Unless otherwise specified, the terms detailed in this Agreement apply generally when using this App. Single or additional conditions of use or access may apply in specific scenarios and in such cases are additionally indicated within this document.


License Grant

1. Subject to this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install and use the App for your personal, non-commercial purposes on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

2. The App is licensed, not sold, to you. All rights not expressly granted to you in this Agreement are reserved by the Developer.

3. You may not rent, lease, lend, sell, redistribute or sublicense the App.

4. You may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App, or any part of it, except as permitted by law.


Basic Terms

1. You are responsible for any activity that occurs when you use the App on your device.

2. You are responsible for safeguarding your device and your Apple ID password, and for any purchases made with them.

3. You must not use the App to abuse, harass, threaten, impersonate or intimidate other people.

4. You may not use this App for any illegal or unauthorised purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.

5. You are solely responsible for the photos, images, text and any other content that you edit, create, save or share with the App.

6. You must only edit photos that you own or have permission to use. You must not edit photos of other people in a way that harms them, misleads others, or invades their privacy.

7. You must not copy, create a derivative work of nor modify another app to falsely imply that it is associated with this App.

8. You must not interfere with or disrupt the App or any servers or networks connected to Kruti Italiya, such as by transmitting worms, viruses, or any code of a destructive nature.

9. You must not, in using the App, intentionally or unintentionally violate any applicable local, state, national, or international law. Violation of any of these terms will result in the termination of your license to use the App. While we prohibit such conduct and content, you understand and agree that Kruti Italiya cannot be responsible for the content you create with the App.


General Conditions

1. We reserve the right to modify or terminate the App or our service for any reason, without notice at any time.

2. Kruti Italiya reserves the right to change or modify this Agreement at any time, in its sole discretion, by posting changes in the App or on this page. Your continued use of this App will constitute your acceptance of such changes or modifications. What constitutes a material change will be determined at our sole discretion, in good faith and using common sense and reasonable judgment.

3. We reserve the right to refuse service to anyone for any reasonable judgment.

4. As a condition of your use of this App, you agree that Kruti Italiya has the right, for any purpose, to retain, use and publish in an aggregate manner non-personal information collected from your use of the App. Your photos are processed on your device and are not collected by us.

5. This license is effective until terminated by you or by us. Your rights under this license will end automatically if you fail to comply with any of its terms. When the license ends, you must stop all use of the App and delete all copies of it.

---> Fees and Subscription Terms

The App offers an optional premium subscription, "Remove BG Pro", with weekly, monthly and yearly plans. Prices are shown in the App before you buy and may vary by country.
If you have purchased the subscription through the Apple App Store, the following conditions apply:

• Confirm Subscription: Payment will be charged to your Apple ID account at confirmation of purchase.

• Manage Subscriptions: You can manage or cancel your subscription in your Apple ID account settings (Settings > your name > Subscriptions).

• Auto-renewal: Your subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period. No cancellation of the current subscription is allowed during the active subscription period.

• Free trial: A free trial (if offered) will automatically convert to a paid subscription after it ends, unless you cancel at least 24 hours before the trial ends. If you subscribe to the premium version before the trial period ends, the current trial will end automatically.
You acknowledge that, if we change the Fees, this will not affect your existing subscription. If you have signed up for a subscription at a certain Fee, any Fee changes will not affect your current subscription or any Renewals.


Disclaimer of Warranty

The App is provided "as is" and "as available", without warranty of any kind. We try to give accurate and high-quality results, but we do not guarantee that background removal or any other feature will be perfect, error-free or suitable for every photo or purpose. You use the App and the images you create at your own risk. Kruti Italiya is not responsible for any loss of photos or data, so please keep a backup of important photos.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App.


Limitation of Liability

To the maximum extent permitted by law, Kruti Italiya will not be liable for any indirect, incidental, special or consequential damages, including loss of data or photos, arising out of or related to your use of or inability to use the App.


You agree not to use this App to:

1. Create, upload, post, email, transmit, share or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;

2. Create or share any material that infringes copyrighted material or promotes the violation of intellectual property rights of others, including but not limited to trademark and patent violations;

3. Create or share fake, misleading or harmful edited images of real people without their permission;

4. Create or share any unsolicited or unauthorised advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation;

5. Impersonate any person or entity, including, but not limited to, Kruti Italiya, or falsely state or otherwise misrepresent your affiliation with a person or entity;

6. Disobey any requirements, procedures, policies or regulations connected to this App.


Refund Policy

1. For in-app purchases made through the App Store, we do not have the right to issue any refunds. The only way to receive a refund for such purchases is to contact Apple at https://reportaproblem.apple.com.

2. Please note that automatic renewal of the service might occur for in-app purchases made through the App Store. In such a case, refunds will not be issued by us. Users are responsible for cancelling future renewals in their App Store account settings.


Copyright

All the resources in the App, including the images, backgrounds, fonts, icons, videos and texts, are protected by trademark and copyright. Any use of these resources without permission is illegal. All right, title, and interest in and to this App (excluding photos and content provided by users) are and will remain the exclusive property of Kruti Italiya and its licensors. The App is protected by copyright and trademark laws. Nothing in this Agreement gives you a right to use the App name or any of the App trademarks, logos, domain names, images, videos, audios, texts or other distinctive brand features.

You keep all rights to your own photos and the images you create with the App.
Any feedback, comments, or suggestions you may provide regarding this App are entirely voluntary, and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.


Apple Terms

1. Maintenance and Support: Kruti Italiya, not Apple, is solely responsible for providing any maintenance and support for the App. Apple has no obligation to provide any maintenance or support services for the App.

2. Product Claims: Kruti Italiya, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.

3. Intellectual Property: If a third party claims that the App or your use of it infringes their intellectual property rights, Kruti Italiya, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of that claim.

4. Legal Compliance: You confirm that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

5. Third-Party Terms: You must comply with applicable third-party terms of agreement when using the App.

6. Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of this Agreement. Once you accept this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
